CMS marketing rules

CMS marketing rules govern how Medicare Advantage and Part D plans, and the agents and marketing organizations selling them, may market to beneficiaries in the United States. They cover required disclaimers, call recording, consent to contact, and what an unlicensed agent may and may not say on a call.

The rules are why Medicare fronting scripts are so tightly constrained: an unlicensed fronter may qualify a caller but may not discuss specific plan benefits.

What the rules mean on a live call

CMS, the Centers for Medicare and Medicaid Services, publishes the rules each year, largely through regulations and its Medicare Communications and Marketing Guidelines. Third-party marketing organizations, which include most call centers selling Medicare plans, have specific duties. One example is the standard disclaimer that the organization does not offer every plan in the caller's area, which CMS currently requires early in the call. Sales and enrollment calls are generally expected to be recorded in full.

On a fronter call from Lahore, that means the disclosure and disclaimer are read exactly as approved, the fronter asks only the qualifying questions, and anything about specific plans, premiums or benefits waits for the licensed agent.

Common mistakes

A fronter answering "will this plan cover my dentist?" Unlicensed agents should redirect plan questions to the licensed agent.

Using last year's script. CMS updates the rules and model language, often ahead of AEP. Check the current guidelines, and confirm with the plan's compliance team or counsel.

Recording only part of the call, so the disclaimer cannot be proved later.

How the rules show up in reports

CMS compliance is mostly proved after the fact, from recordings. QA on a Medicare campaign should check every call for the disclaimer and disclosure, not a small sample, and a missing disclaimer should be its own failure code. Keep recordings for as long as the plan or carrier contract requires, which is often several years.

Plans also audit their marketing partners. When a plan asks for a batch of calls, a floor should be able to pull them by date, agent and phone number quickly.
